In other words, the same number of senators voted for and against those provisions remaining as they are. Because a majority was not reached, the motion failed and those provisions will be removed from the bill.
According to the bills digest:
Proposed subsection 546(3A) provides that any penalty based on the new ‘value of the benefit’ method outlined above may only be payable to the Commonwealth. The Explanatory Memorandum contains no rationale as to why this is the case.
