Title

Description

  • The majority disagreed with a series of [Greens amendments](http://www.openaustralia.org/senate/?gid=2014-10-29.62.1) that proposed to change a lot of the [bill](http://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;query=Id:legislation/billhome/s976)'s provisions. For example, they wanted to include more exceptions into the offence of entering and staying in a declared area and give judges more room to interpret what a legitimate purpose to be in those areas would be.
  • The amendments are known as "amendments numbers (1) to (3) and (20) to (24) on [sheet 7594](http://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;query=Id:legislation/billhome/display.w3p;query=Id%3A%22legislation%2Famend%2Fs976_amend_346553d1-a62c-4ad7-82f5-f1d526256f7b%22;rec=0), and amendments (1) to (3) on [sheet 7598](http://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;query=Id:legislation/billhome/display.w3p;query=Id%3A%22legislation%2Famend%2Fs976_amend_2ed09b03-db19-4495-b616-0e85c63eb75f%22;rec=0), and amendments (1) to (8) on [sheet 7599](http://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;query=Id:legislation/billhome/display.w3p;query=Id%3A%22legislation%2Famend%2Fs976_amend_cee771be-091b-4872-a6d4-82d35d963bf4%22;rec=0)".
  • ###Enter or stay in declared area offence
  • The bill will make it an offence for someone to enter or stay in an area that the [Minister for Foreign Affairs](https://theyvoteforyou.org.au/people/representatives/curtin/julie_bishop) declares as a declared area. A whole country can be a declared area, which was [criticised](http://www.abc.net.au/news/2014-10-17/parliamentary-committee-recommends-passing-of-foreign-fighters-/5821514) by the [Joint Parliamentary Committee on Intelligence and Security](http://en.wikipedia.org/wiki/Parliamentary_Joint_Committee_on_Intelligence_and_Security).
  • The current exceptions to this offence (in [proposed subsection 119.2(3)](http://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;db=LEGISLATION;id=legislation%2Fbills%2Fs976_first-senate%2F0001;query=Id%3A%22legislation%2Fbills%2Fs976_first-senate%2F0001%22;rec=0)) include when a person is involved in:
  • * [humanitarian aid](http://en.wikipedia.org/wiki/Humanitarian_aid) (but this has to be the sole act),
  • * a court case,
  • * work for an Australian government (state or federal),
  • * work for a foreign government (so long as it's not violating Australian law),
  • * work for the [United Nations](http://en.wikipedia.org/wiki/United_Nations),
  • * journalism, and
  • * visiting a family member.
  • Read more about this new offence in the [bills digest](http://www.aph.gov.au/Parliamentary_Business/Bills_Legislation/bd/bd1415a/15bd034).
  • ###Background to the bill
  • A number of incidents happened before and after this bill's introduction. There was [one of the biggest counter-terrorism operations](http://www.abc.net.au/news/2014-09-18/authorities-thwart-beheading-plot-in-australias-biggest-raid/5754276) in Australian history. The Prime Minister [Tony Abbott](https://theyvoteforyou.org.au/people/representatives/warringah/tony_abbott) also confirmed that Australia would be [sending the military to Iraq](http://www.abc.net.au/news/2014-10-15/special-forces-could-move-into-iraq-within-days-abbott/5815534) to fight the [Islamic State](http://en.wikipedia.org/wiki/Islamic_State_of_Iraq_and_the_Levant) (IS) (also known as the Islamic State of Iraq and Syria (ISIS) or the Islamic State of Iraq and the Levant (ISIL)).
  • Two particularly significant incidents were when:
  • * Australian teenager [Abdullah Elmir](http://www.abc.net.au/news/2014-10-21/australian-is-fighter-threatens-tony-abbott-in-video/5830040) threatened Prime Minister Tony Abbott in an IS video;
  • * Canadian gunman [Michael Zehaf-Bibeau](http://www.abc.net.au/news/2014-10-23/canadian-parliament-in-lockdown-after-gunman-shoots-soldier/5834692) attacked the Canadian Parliament.
